These Terms of Service (“Terms”) govern your use of dinerpedia.com (the “Site”), operated by the Dinerpedia project (“we,” “us”). By accessing or using the Site, you agree to these Terms. If you don’t agree, please don’t use the Site.

The service

Dinerpedia is a free, community-built encyclopedia of American diners, both open and closed. Information is provided for general and historical interest and may be incomplete, outdated, or inaccurate.

Your account

Some features require signing in. You’re responsible for the activity under your account and for keeping your access secure. Provide accurate information and don’t impersonate others.

Your contributions

You retain ownership of the photos, comments, and other content you submit. By submitting content, you represent that you have the right to do so, and you grant Dinerpedia a worldwide, non-exclusive, royalty-free license to store, display, reproduce, and distribute that content on the Site in connection with operating and promoting Dinerpedia. You can request removal of your content by emailing us.

You agree not to submit content that:

— infringes anyone’s intellectual property or privacy rights; — is unlawful, defamatory, hateful, harassing, or obscene; — is spam or advertising; or — misrepresents a diner or another person.

Moderation

Contributions are reviewed by our editors before they appear. We may edit, decline, or remove any content, and suspend accounts, at our discretion to keep pages accurate and respectful.

Acceptable use

Don’t misuse the Site — including scraping at scale, attempting to disrupt or gain unauthorized access to it, or using it to violate any law. Automated bulk access to our data is not permitted without permission.

Intellectual property & sources

The Dinerpedia name, design, and original content are ours or our contributors’. Some diner data and photos come from third-party sources such as Google Places, OpenStreetMap (© OpenStreetMap contributors, ODbL), and the Internet Archive, and remain subject to their respective licenses. Dinerpedia is not affiliated with, endorsed by, or sponsored by any diner or business listed on the Site.

Disclaimers

The Site is provided “as is” and “as available,” without warranties of any kind. We don’t guarantee that any diner’s hours, status, location, or details are current or correct — always confirm with the establishment before visiting.

Limitation of liability

To the fullest extent permitted by law, Dinerpedia and its contributors will not be liable for any indirect, incidental, or consequential damages arising from your use of the Site.

Third-party links

The Site links to external websites and services (such as diners’ own sites and social profiles). We’re not responsible for their content or practices.

Termination

You may stop using the Site at any time. We may suspend or terminate access if you violate these Terms.

Governing law

These Terms are governed by the laws of the State of New Jersey, USA, without regard to its conflict-of-laws rules.

Changes

We may update these Terms from time to time; the “Last updated” date above reflects the latest version. Continued use of the Site means you accept the updated Terms.
